The internet record store FaN is owned and managed by Dariusz Czapka, ul. Sienkiewicza 42, 25-507 Kielce, Poland, trading under the name of Fan registered with the Kielce municipal register of business entities under entry no. 6915/92/H, REGON 290020319, EU VAT No. PL6570010990, and its official web address is www.fan.pl.

FaN is engaged in sales of goods through the www.fan.pl web site, with the use of remote communications.

The store receives orders through an order form available at the www.fan.pl in such a way that a Customer, after selection of an item of choice and clicking on the price adds the item to the so called "shopping cart" and consequently, after clicking on the "order" button is automatically directed to the order form.

After placing an order the Customer receives an order confirmation by e-mail. The confirmation contains a list of ordered items, unit and total price, cost of delivery, mode and date of delivery.

In the event ordered items are not in stock or are not available with suppliers the Customer shall be immediately notified thereof and shall be asked for decision as to further course of action (e.g. further date of delivery of resignation from purchase).

Time of delivery varies depending on type of item. Order fulfillment time shall be understood as the time elapsed between receipt of the order by Fan and dispatch of the ordered goods to the Customer. The following terms of delivery shall apply:
a) up to 7 days - orders for items in stock
b) 7-14 days - orders for items acquired at the Customer's request
c) 14-28 days - orders for goods imported at the Customer's request
d) should the Customer place and order prior to the release date, the item shall not be delivered earlier than on the release date.

Ordered goods shall be delivered through Poczta Polska or a messenger service company. Delivery receipt date = order fulfillment time + time of delivery by Poczta Polska or a messenger service company.

All prices include VAT. Cost of delivery is added to item unit price. Prices listed next to items are applicable while placing order. At any time FaN shall have the right to change prices of offered goods, introduce new items and use the FaN store web site to organise promotional campaigns.

The following modes of payment for ordered goods are available:

In the event a manufacturing fault is found by the Customer in delivered goods, the Customers shall immediately sending such information by e-mail, to the address sklep@fan.pl and shall send the faulty goods to FaN, Sienkiewicza 42, 25-507 Kielce, Poland. Faulty goods shall be replaced as soon as possible. In the event no replacement is available in stock, FaN shall either offer to the Customer an equivalent item at the same price or refund the purchase price of faulty goods. Detailed guidelines regarding complaints are included in the Complaints procedure, which is an integral part hereof.

Pursuant to the protection of consumer rights and liability for damages caused by hazardous objects act of March 2nd 2000 (Journal No. 22, item 271) a customer is entitled to resign from purchase of goods effected with FaN at sole discretion, within 10 days of receipt if delivery. Customer shall be entitled to resign from purchase provided the goods remain intact and were not copied or otherwise damaged. Goods shall be returned in intact, original packaging, with original invoice or receipt. FaN guarantees return of purchase price to a bank account specified by customer or by postal order to the original goods delivery address. No refund shall be made for cost of delivery of faulty goods. Goods showing traces of opening or use shall be resent to the Customer at the Customer's sole expense. Detailed guidelines regarding withdrawal from a contract are included in the Withdrawal from contract procedure, which is an integral part hereof.

Sales contract is entered into by the Customer and FaN Dariusz Czapka, ul. Sienkiewicza 42, 25-507 Kielce, Poland. Essential provisions of the contract shall be recorded, secured and made available to the Customer through delivery of a printed copy thereof, together with a VAT invoice, receipt or order specification.

The contract shall be governed by Polish law. The contract language shall be Polish.

Disputes arising from the contract shall be settled by the appropriate court for the seat of the seller.

The foregoing Shopping regulations come into force as of the date of publication on www.fan.pl, i.e. August 30, 2005.
